Overview

This is the Privacy Policy of CEC International, Inc., a California corporation (“CEC,” “we,” or “us”).  Our Terms of Service and Product Agreement, both of which incorporate this Privacy Policy by reference, govern your use of our websites and Products (defined below).  Any capitalized terms that are not defined in this Privacy Policy are defined in the Terms of Service or Product Agreement.

 

Please read the Terms of Service and this Privacy Policy carefully. IMPORTANT: BY USING OUR WEBSITES AND/OR THE FEATURES AVAILABLE ON OUR WEBSITES AND /OR BY USING A PRODUCT, YOU GIVE YOUR CONSENT THAT ALL PERSONAL DATA THAT YOU SUBMIT OR THAT MAY BE COLLECTED BY USING A PRODUCT MAY BE PROCESSED BY US IN THE MANNER AND FOR THE PURPOSES DESCRIBED BELOW. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, DO NOT USE OUR WEBSITES OR THE PRODUCT.

 

Definitions.  For purposes of this Privacy Policy:

 

“Product” means the cFloat System (“cFloat”) and any other tangible CEC product marketed by CEC, including any related Software.  

 

“Product Information” includes pool-related data gathered by your cFloat Product (such as water temperature, water chemistry, and movement detection data from your swimming pool) and any other data gathered or transmitted via your Products or Software.

 

“Software” means (A) the software pre-installed by CEC on each Product, and (B) any downloadable software applications provided by CEC for use in connection with a Product.

 

Types of Information We Collect.

We collect two types of information about our users: Personal Information and Aggregate Information.

 

Personal Information: This refers to information that lets us know the specifics of who you are. When you engage in activities such as registering for an account, sending us feedback, or configuring a Product, we may ask you to provide certain information about yourself. Examples of Personal Information may include your first and last name, email address, physical location (including zip code), telephone number, your wifi network login & password, your credit card information and other identifying information. 

 

Aggregate Information: This refers to aggregated or anonymized information that does not by itself identify a specific individual. We gather certain information about you based upon the CEC websites you visit and what other sites may have directed you to us. This information, which is collected in a variety of different ways, is compiled and analyzed on an aggregated basis. This information may include the Website's Uniform Resource Locator ("URL") that points to the site you just came from, the URL you go to after visiting our Site, the type of browser you are using, and your Internet Protocol ("IP") address. We also gather Product Information.  This may include environmental data like air and water temperatures, humidity, air pressure, UV index and water chemistry data.

 

How We Collect and Use Information

We may collect Personal Information about you if you voluntarily provide it to us or if another user provides it to us. You may be required to provide certain Personal Information to us when you elect to use certain features of CEC, such as: (a) registering for an account; (b) configuring a Product; (c) sending us an email message; (d) signing up for special offers from third party advertisers; or (e) submitting payment information.  Your cFloat Product will also provide Product Information to us such as environmental data, including air and water temperatures, humidity, air pressure, UV index and water chemistry data. We may associate this Product Information with your Personal Information by (for example) transmitting it to your electronic devices.

 

We use your Personal Information to enable you to order and use your Product, improve our marketing and promotional efforts, statistically analyze website use, improve our Product and service offerings, and customize CEC's website content and layout. We may use Personal Information to deliver information to you, including Product Information and targeted advertisements, and to contact you regarding administrative notices. We may also use your Personal Information to resolve disputes, troubleshoot problems and enforce our agreements with you, including our Terms of Service and this Privacy Policy. Finally, we may share your Personal Information with our Partners (defined below), such as shipping companies, in order to provide the Products and services you may purchase.

 

We and our third party business partners may also collect certain Aggregate Information.  For example, when you visit CEC websites, we may use tracking technologies such as cookies to facilitate access to CEC websites and to personalize your online experience. A cookie is a small data file that is sent by Web servers to your computer’s hard drive, where your Internet browser files are kept. Through the use of a cookie, we also may automatically collect information about your online activity on CEC websites, such as the web pages you visit, the links you click, and the searches you conduct on CEC websites. Most browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies. If you choose to decline cookies, please note that you may not be able to sign in or use some of the interactive features offered on CEC websites. The information we obtain in this manner enables us to customize the services we offer our website visitors, to deliver targeted advertisements, and to measure the overall effectiveness of our online advertising, content, programming or other activities. We may also allow business partners, contractors and other third parties to display advertisements on CEC websites.  These companies may use tracking technologies, such as cookies, to collect information about users who view or interact with their advertisements. This information allows them to deliver targeted advertisements and gauge their effectiveness.  

 

We do not separately collect Personal Information about your online activities over time and across different websites when you use CEC websites.  If you choose to click on an advertisement or other link displayed in CEC websites, we may track this information.  If we already have your Personal Information, (because you or another user provided it to us), we may associate that Personal Information with your online activities over time and across different websites.  If you use a mechanism such as a web browser “do not track” signal to prevent collection of Personal Information about your online activities over time and across different websites, we will not deliberately attempt to override your choice.  However, technology in this area is evolving, and it is possible that the technology of CEC websites may automatically override your choice without any deliberate action on our part.  Because of this, we cannot guarantee that CEC websites will respect your choice. Furthermore, we cannot guarantee whether a third party business partner which has content embedded in CEC websites (such as an App, which is defined below) will track your online activities over time and across different websites, nor how the third party business partner will respond to a “do not track” signal.

 

Release of Information

We will not sell, trade, or rent your Personal Information to others.  We may provide some of our Products through contractual arrangements made with affiliates, service providers, partners, distributors and other third parties (collectively, "Partners"). As discussed above, we may share Personal Information with Partners in order to provide the Products and services you may purchase and to make the CEC websites and Products function.

 

Please note that the use of your Personal Information by third parties, including Partners, is governed by the respective privacy policies of those third parties, and is not subject to our control. Except as otherwise discussed in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you. Other websites accessible through CEC, including those of third parties who may advertise through the Site, have their own privacy policies and data collection, use and disclosure practices. Please consult each third party’s site's privacy policy. We are not responsible for the policies or practices of third parties.

 

Occasionally we may be required by law enforcement or judicial authorities to provide Personal Information to the appropriate governmental authorities. In such cases, we will disclose Personal Information upon receipt of a court order or subpoena or to voluntarily cooperate with a law enforcement investigation. We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.

 

If CEC is involved in a merger, acquisition, asset sale, divestiture, or similar transaction, we may disclose Aggregate Information and Personal Information to the party that acquires CEC.

 

Finally, we may also provide Aggregate Information to third parties, including advertisers.  This may include data about our customers' sales, traffic patterns, related Site information, Product use statistics, and environmental data collected by Products.  However, we will not provide Personal Information to third parties except as discussed above.

 

Use by Minors

CEC is not intended for use by anyone under 18, except with the explicit permission and under the supervision of a parent or guardian who accepts full legal responsibility for the minor's use. No person under 13 should disclose information on CEC websites. We do not knowingly collect or use personally identifiable information from children under 13. If a child under 13 has provided us with personally identifiable information without parental or guardian consent, the parent or guardian should email us at privacy@cfloat.coto remove the information. Notice Regarding Content Provided by Minors

Any minor who has registered as a user by setting up an account with us may request and obtain removal of any content or information posted on CEC websites. To have such content or information removed, please email us at privacy@cfloat.coto request removal.  Please note that removal of content or information posted on CEC websites does not ensure complete or comprehensive removal of the content or information if (for example) another party has copied or reposted the content or information.

 

Updates and Notices

Periodically, CEC may send you email communications detailing new features or promotions on CEC or new features and upgrades to our Products. You may “opt-out” from these messages by using the link at the bottom of the email. We may also send you email messages about the status of your account or any notices as required by law. You may not opt-out of receiving these administrative emails so long as you continue to use this voluntary service.

 

Your Information, third-party Apps, & Links to Other Websites

CEC may make third-party applications such as the Facebook Like button or Google Analytics (each an “App”) available to you for use in connection with your Product. Also, CEC contains links to other websites not owned by us (each a “Third-Party Site”). 

                                                                                                                

Your interactions with each App and Third-Party Site are governed by the terms of service and privacy policy of the company providing the App or Third-Party Site. We are not responsible for the content or privacy practices of any third party, even if we happen to host or link to its Third-Party Site or App, and our Privacy Policy does not apply to information collected by any third party. You should read each third party’s privacy policy to make sure you agree to its terms before using an App or Third-Party Site.

 

Personal Security

In an effort to prevent unauthorized access, disclosure or accidental loss or destruction of your personally identifiable information, we use reasonable efforts to secure the information you provide. ALTHOUGH WE TAKE REASONABLE STEPS TO SAFEGUARD AND PREVENT UNAUTHORIZED ACCESS TO YOUR PERSONALLY IDENTIFIABLE INFORMATION, WE CANNOT BE RESPONSIBLE FOR THE ACTS OF HACKERS AND OTHERS WHO GAIN UNAUTHORIZED ACCESS, AND WE MAKE NO WARRANTY, EXPRESS, IMPLIED OR OTHERWISE, THAT WE WILL PREVENT SUCH ACCESS. YOU ASSUME ALL RISKS, INCLUDING BUT NOT LIMITED TO THE RISK OF IDENTITY THEFT, RELATING TO THE ACTS OF THOSE WHO GAIN UNAUTHORIZED ACCESS. COMMUNICATIONS YOU MAY HAVE WITH US VIA EMAIL OR U.S. MAIL MAY NOT BE SECURE UNLESS WE ADVISE YOU THAT SECURITY MEASURES ARE IN PLACE PRIOR TO YOUR SENDING INFORMATION. THEREFORE, IF YOU CHOOSE TO COMMUNICATE WITH US THROUGH THESE MEANS, YOU ARE ASSUMING THE RISK OF DOING SO AND WE REQUEST THAT YOU DO NOT SEND OR POST SENSITIVE INFORMATION THROUGH THESE MEANS.

 

Please remember to help keep CEC secure by never sharing your username or password. If you think your password may have been compromised, please change it immediately or contact CEC for additional assistance.

 

Changes to Privacy Policy

The Terms of Service and the Privacy Policy may be modified by us from time to time. If you have established a user account with us, we will also notify you by sending an email to the email address you most recently provided us in your account profile (unless we do not have such an email address).  We are not responsible if any email notice gets caught by your SPAM filter and you do not see it, if you have given us the wrong email address or failed to update your address, or if there are other communications issues that prevent email from reaching you. Therefore, we encourage you to periodically visit this page to monitor any changes. The date the Privacy Policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable e-mail address for you, and for periodically visiting CEC and this Privacy Policy to check for any changes.

 

International Users

CEC websites are hosted and operated in the United States of America. Those who access or use CEC websites from other jurisdictions or use a Product in other jurisdictions do so at their own choice and risk and are solely responsible for compliance with local law. Please note that the personal information you submit to CEC will be transferred to and stored in the United States to be processed by us so we can provide CEC websites, Products, and services to you. 

 

If you are not a resident of the United States, you acknowledge and agree that we may collect and use your personal information outside your home jurisdiction, and that we may store your personal information in the United States. Please note that the level of legal protection provided in the United States or other non-European countries in which you may access CEC may not be stringent as that under European Union privacy standards or the privacy laws of some other countries, possibly including your home jurisdiction. 

 

California Privacy Rights
